- The Power to Recall: The regulatory body would have the authority to mandate software updates, restrict the use of, or order a full “recall” (de-deployment) of AI systems that are found to be causing significant, unforeseen harm post-release. This provides a vital mechanism to address the “accumulative risk” problem by ensuring that harms do not go unchecked indefinitely.22
Part IV: Answering the Critics: Fostering Innovation Through Responsible Guardrails
The most common and forceful argument against comprehensive AI regulation is that it will stifle innovation, increase costs, and create insurmountable barriers for startups, ultimately ceding technological leadership to less constrained global competitors.30
This view, however, is based on a flawed understanding of both regulation and innovation.
A well-designed regulatory framework does not have to be a brake on progress; it can be a steering wheel, guiding innovation toward more robust, trustworthy, and ultimately more valuable outcomes.
It is true that a framework like the one proposed would increase the cost and time of development for high-impact AI systems.31
This is not a bug; it is a feature.
The FDA process is famously long and expensive, but it also prevents countless catastrophes and builds the immense public trust that is necessary for the multi-trillion-dollar pharmaceutical market to exist at all.
The same principle applies to AI.
The concern that only Big Tech could afford such compliance, crippling smaller competitors, is valid but addressable.32
The phased approach is inherently scalable.
The full, rigorous process would apply only to systems with the potential for widespread societal impact.
A low-risk startup building a simple chatbot might only need to clear the minimal requirements of Phase 0 and 1, while a company building an AI for autonomous vehicles or medical diagnostics would face the full gauntlet.
This prevents a “race to the bottom” on safety and allows startups to compete on quality and trust, not just reckless speed.
The argument that regulators cannot possibly keep up with the pace of technology and that laws will be outdated upon arrival is a powerful critique of static, list-based regulation.33
It is, however, precisely the weakness that a dynamic, process-based framework is designed to overcome.
By regulating the
process of validation rather than the specific technology, the framework remains relevant no matter what the next architectural breakthrough may be.
The burden of proof remains on the innovator to demonstrate safety through a standardized process.

The unregulated path leads to a future of reckless, brittle, and untrustworthy innovation, where market power concentrates in the few large firms that can afford to weather the inevitable scandals and public backlash.30
A well-regulated path leads to a future of robust, resilient, and trustworthy innovation distributed across a competitive and healthy market.
By creating a clear, predictable regulatory pathway, this framework actually
de-risks the innovation process for investors and entrepreneurs.30
It builds the public trust that is the essential prerequisite for adopting AI in the highest-value sectors of our economy and society.33
Most importantly, it turns safety, ethics, and robustness from a mere cost center into a source of profound competitive advantage, creating a market that incentivizes a race to the top, not the bottom.
Conclusion: From Unseen Architects to Accountable Engineers
The image of that biased hiring algorithm, silently and efficiently perpetuating injustice, represents the core danger of an unregulated AI future.
It is a future shaped by unseen architects, whose values and biases are encoded into systems that govern our lives without transparency, accountability, or recourse.
The despair that experience induced was born of a feeling of powerlessness against a technology that seemed to be moving too fast to be understood, let alone guided.
The discovery of the FDA analogy provided the missing piece: a blueprint for responsible stewardship.
The risks of AI—bias, privacy invasion, economic disruption, geopolitical instability, and the slow erosion of societal resilience—are too systemic and too severe to be left to market forces alone.
